Terms and Conditions
Thank you for choosing The Fitzroys Photography to document your child’s story within their early learning environment. It’s a privilege to capture these fleeting, meaningful moments as they naturally unfold.
Our Photography Style
Our approach is gentle, observant, and child-led. We photograph children as they explore, create, and connect—capturing authentic expressions and quiet in-between moments. Each gallery is thoughtfully curated to reflect your child’s personality and the atmosphere of their learning space.
Registrations
To ensure a smooth and respectful photography experience, all children must be registered prior to photo day. If a registration has not been completed, we are unable to photograph your child under any circumstance.
Late Registrations
Late registrations may be accepted at the discretion of The Fitzroys Photography; however: Your child may be photographed without prior notice. Our schedule may already be at capacity, and inclusion cannot be guaranteed. We warmly encourage registering before the deadline to ensure your child is included.
Registration Fee
Your registration fee of $20 is fully redeemable when placing an order, however it is non-refundable
Your Child’s Photo Day
Families will be notified of their child’s scheduled photo day ahead of photo week via email and/or text. Where photography takes place over multiple days, individual schedules will be shared in advance. For centres hosting a single advertised photo day, individual notifications will not be sent. It is understood that all attending children may be photographed, as communicated by the centre and our materials. While we make every effort to share clear communication, it is the responsibility of families to note these dates once released. The Fitzroys Photography is not responsible for missed photo days due to unawareness of the schedule.
Refunds and Reshoots
If your child is unable to participate in their session, your registration fee will be refunded. If you feel your gallery does not meet expectations, we will carefully review the images in line with our brand standards. Where images meet our standards, refunds or reshoots are not offered. Where images fall short, your registration fee will be refunded. If multiple children are registered but only one is photographed, the full registration fee applies to the photographed child. While we always aim to capture sibling images, at times they cannot be guaranteed.
Special Requests
Due to the dynamic, child-led nature of early learning environments, we are unable to guarantee specific outcomes. Sessions are guided by each child’s comfort, the rhythm of the day, and centre routines.
Centre – Cancelled Bookings
If a centre cancels or postpones a confirmed booking, the Family Registration Fee is retained by The Fitzroys Photography as a non-refundable booking retainer. This reflects the time, preparation, and reserved dates allocated for your centre.
Clothing and Hair
Please send your child in clothing you feel comfortable seeing captured in their photographs. A spare outfit is always recommended. We do not offer reshoots or refunds based on clothing choices. While we gently tidy hair where possible, we cannot guarantee styles will remain as intended throughout the day.
Resitting Fee
A $50 re-sitting fee applies where a session is requested again due to dissatisfaction with clothing or hair. This fee is not redeemable on products.
Absent or Unwell Children
If your child is absent or unwell, your sitting fee will be refunded. For the wellbeing of all children and educators, we kindly ask that unwell children are not sent to care solely for photos. Where possible, we will try to accommodate missed sessions, though this cannot be guaranteed.
Multiple Children Policy
Each package is designed for one child. For multiple children, individual packages are required. If only one child is photographed, the full registration fee applies to that child. Sibling images, when captured, are available for separate purchase.
Group Photos
Group photos are offered for kindergarten-aged children, depending on centre participation. A signed permission form is required by the due date for inclusion. 3-year-old groups are photographed at sessional kindergartens only, at the centre’s discretion. 4-year-old groups are photographed at participating centres. Only first names are included, with last initials added where needed. Group images are available for purchase within your gallery, where applicable.
Image Retention
Galleries are available for 3 months. We recommend downloading and safely backing up your images to ensure they are preserved for years to come.
Marketing and Promotional Use
With your consent, images may be shared by The Fitzroys Photography across print materials and galleries.

The Fitzroys Photography uses carefully designed systems to deliver consistent, high-quality galleries for every family. This is not a bespoke photography service, but every gallery is created with intention and care.

I will send my child to their session in clothing I feel confident having photographed, along with a second outfit I am equally happy with in the event their clothing becomes soiled

I acknowledge that The Fitzroys Photography cannot guarantee how my child’s hair will be styled or maintained throughout the day

I understand that each child engages in their own unique way during their session
My gallery may include a variety of expressions - ranging from direct smiles to quiet, candid moments of my child immersed in play and exploration
In the interest of the health and wellbeing of all children and educators, I will not send my child to care if they are unwell and would otherwise be resting at home
I understand that photographers from The Fitzroys Photography reserve the right not to photograph unwell children.
I accept that if my child is not photographed due to absence, a full refund will be provided
Where applicable - Children are never required to participate in group photos. If my child chooses not to take part, they cannot be added into the image at a later stage
I acknowledge that some centres may choose not to offer group photos. Where a group photo is taken and includes my child, it will be available for purchase within my gallery
I understand that The Fitzroys Photography uses carefully designed, automated processes to deliver a consistent and seamless experience
I consent to receiving relevant communication via SMS and email in relation to my child’s photography session
I understand that it is my responsibility to read and agree to these conditions
